Terms and Conditions of Business and Use
1.1. Wine bought from us direct, or from our web site, is done so under these Terms and Conditions. By registering on our web site, you are agreeing to be bound by these Terms and Conditions. These Terms and Conditions may change from time to time through updates to this notice.
1.2 The minimum order is 12 bottles. Orders in excess of the
minimum must be in multiples of 6 bottles.
2.1. Our wine list contains over a 100 selected wines for sale. We believe that our wines represent the best quality and price for wines from this exceptional region of France.
2.2. Our Price Promise is that if you buy wine from us and then find the same wine for sale in the mainland UK at a cheaper price within 7 days (but not on sale, promotion or special offer) we will refund the difference.
2.3 We aim to deliver within three working days. At present, we only deliver in the mainland UK. The delivery charge is £4.50 per delivery. It does not increase if you order more than one case.
2.4. If any of our wine is defective, we will credit your account for the full amount, including delivery, as soon as we will have it collected from you, provided, of course, you have only consumed one bottle from the case.
2.5 All wines are subject to availability. Some of our wines are produced by small specialist growers and may exist in limited quantities. When that supply is exhausted, it is not possible to replace it. Wherever possible, we will try to provide a comparable or better vintage at the same price. We will be happy to discuss any proposed substitution with you before despatch.
3.1. All prices shown are per case and are quoted in pounds sterling. The prices include Value Added Tax. The delivery charge is additional. All bottles are a minimum 75cl unless indicated. We accept payment by Visa or MasterCard, Switch and Solo.
4.1. Delivery is £4.50 per delivery regardless of how many cases you order. We will deliver as soon as possible, which is usually within three working days. We can only deliver to mainland UK addresses.
4.2. Your goods should be opened and examined upon arrival. If this is not possible, then you must sign the carrier's sheet 'Not Examined'. If there are any breakages, the carrier will need to collect the complete case including the damaged contents.
4.3. If you tell us to, we will leave the goods with a neighbour or in another location specified by you. However, in this situation, we cannot refund any losses if you do not receive your goods.
5.1. For Internet sales, we use a secure payment system provided by WorldPay Ltd. Your credit or debit card details are taken into a state-of-the-art encryption system and are secure with us during and after the transaction.
5.2. To make sure that you don't have to worry, we will make good any losses suffered by you and charged to you by your credit card company, up to a maximum of £150 through the unlawful use by a third party of your credit card, or credit card information, directly as a result of your use of our web site.
5.3. It is your responsibility to protect your password from being disclosed to any third party.
6.1. You may cancel your order for any reason whatsoever within 14 days from the date you receive your wine, provided all of the bottles are unopened and intact. You must call us on 01273-330012, or notify us by fax on 01273-330021 or email on admin@BurgundyWines.co.uk, should you want to cancel your order.
6.2. We shall reimburse the price of the wine within 30 days from the date you notify us of the cancellation, provided our carrier has collected the wine.
6.3. Unfortunately, we are unable to reimburse the delivery charge when you have exercised your right to cancel your order.
7.1. If all of the bottles of wine in a case are broken or spoiled when they are delivered, we will replace the case of wine and reimburse the delivery charge. If one or some of the bottles of wine are broken or spoiled, we will either replace the bottles, issue you with a credit note or provide you with a refund for the cost of the bottles of wine that have been broken.
7.2. Within 30 days from the delivery of the wine, you must call us on 01273-330012, or notify us by fax on 01273-330021 or email on admin@BurgundyWines.co.uk, of all wines which are due to be returned for any of the reasons stated in this clause, otherwise you cannot rely on Clause 7.1 above.
7.3. All refunds and reimbursements under this clause will be paid within 30 days of you notifying us of your wish to return wine under this clause, provided that our carrier has collected the wine.
7.4. Wines collected by our carrier must be in their original box to avoid further breakages.
8.1. We warrant that the wines will be of satisfactory quality. Other than as stated elsewhere in these terms and conditions, all warranties, conditions, terms and undertakings, expressed or implied, whether by statute, common law, custom, trade usage, course of dealings or otherwise in respect of the goods and services provided by us hereunder are hereby excluded to the fullest extent permitted.
9.1. Except in the case of death or personal injury due to negligence or fraudulent misrepresentation for which our insurance limits shall apply:-
- We shall not be liable to you for direct loss for a sum
greater than £500 in respect of any one event or series of connected events.
- We shall not be responsible to you for any indirect consequential or economic loss or damage.
10. Data Protection.
10.1. By registering your details on our web site, you consent to us maintaining, recording, holding and using personal data about you to enable us to process your orders and to improve our service to you.
11.1. By law; we will not sell wine to anyone who is not 18 years old or over. By placing an order you confirm that you are at least 18 years old.
11.2. You agree and acknowledge that we own, or are licensed to use, all copyright, database rights, trademarks and other intellectual property rights in and to all parts of this web site, and to the business of Burgundy Wines Limited, including the structure, design and the layout of the web site.
11.3. You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
11.4. All persons are prohibited from providing hypertext or other links to this web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.
11.5. We shall not be liable for any delay in or for failure to perform obligations if that delay or failure is caused by circumstances beyond our control.
11.6. This Agreement does not confer or purport to confer on any third party any benefit or any right to enforce any term of this Agreement.
11.7. We reserve the right to modify these terms and conditions at any time and in any way.
11.8. These terms and conditions shall be subject to English law and the exclusive jurisdiction of the Courts of England and Wales.
